Josh Marshall writes today:
We'll pass over the current Republican party's rather demonstrable anti-constitutionalism or the fact that conservatives put together a very similar enterprise only a few decades ago. But we did notice that Rush made for the usual victim vamping, imagining that his style of constitutional interpretation or rather he himself might be banned by these folks. And now as it turns out, the sponsors of the conference, specifically the ACS's Yale chapter, has sent Limbaugh a pocket-sized copy of what he calls the "little pretend" constitution (i.e., the United States Constitution), a letter reassuring him that he is very much not banned and an invitation to hold an event featuring Limbaugh on campus.
Which is pretty funny. Though not nearly as funny as:
WASHINGTON, April 14 - As the Senate heads toward a showdown over the rules governing judicial confirmations, Senator Bill Frist, the majority leader, has agreed to join a handful of prominent Christian conservatives in a telecast portraying Democrats as "against people of faith" for blocking President Bush's nominees.
"I have asked the Judiciary Committee to look at the Schiavo case and the actions of the judiciary," said DeLay, a Texas Republican. ''The legislative branch has certain responsibilities and obligations given to us by the Constitution. We set the jurisdiction of the courts. We set up the courts. We can unset the courts. We have the power of the purse. We have oversight of how we spend their money. All of these are oversight tools."
DeLay said the committee would decide whether to recommend impeachment for any of the judges involved in the Schiavo case. He said he had set no time frame for the committee's work.
When asked whether the committee's review should extend to the Supreme Court, which repeatedly refused to hear appeals in the Schiavo case, DeLay would not answer directly, but encouraged reporters to read a recent book on the high court, ''Men in Black." That book, subtitled ''How the Supreme Court is Destroying America," accuses the justices of carrying out an activist agenda that oversteps the bounds set by the Constitution.
Christ, no wonder conservatives think our incredibly conservative, corporately owned media is "liberal". They think the fucking federal judiciary is a bunch of activist liberals!
We haven't had a "liberal" federal judiciary since the Warren court, people. And that court's chief justice, Earl Warren himself, was a conservative appointed by Eisenhower, for crying out loud. And just how "liberal" was that nutty Earl Warren? Well, you might remember him as the conservative governor of California who rounded up all the Japanese Americans on the west coast and stuck them in internment camps during the Second World War.
The guy was like an anarchist!
Who was the other stark raving, treasonous, out of control liberal on that court? Well, that would be Will Brennan, another conservative appointed by Eisenhower.
And, for those of you who are Republicans and, therefore, appear to know dick about the history of America, that country you keep telling us liberals you love so much--though, apparently not enough to learn anything about it--Eisenhower was a conservative Republican.
Who was our next Chief Justice on that out of control, liberal Supreme Court? Well, that would be Warren Earl Burger, appointed by commie, pinko, lefty Richard Nixon. And then, of course, we have our current Chief Justice William "Fidel" Rehnquist, appointed by another well known flaming fucking lefty, Ronald Reagan.
So, that's your "liberal" Supreme Court: dominated by conservatives for fifty years.
Well, fine--but what about the rest of the liberal out of control Court? There are nine Justices in the Supreme Court. Two of them--two--TWO--have been appointed by a Democratic president: Ruth Bader Ginsburg and Stephen Breyer.
The other seven Justices were appointed by Nixon, Reagan, Ford, and George H. W. Bush.
What in the name of holy fuck are these crazy, whiny, crybaby, idiotic right wing nutbags talking about???
They've got their whole ignorant, paranoid, stupid "value voting" base convinced that the Supreme Court is a bunch of elitist, left wing, radicals out to destroy America.
Hey, conservatives, if you don't like the way the Supreme Court keeps ruling, stop appointing conservatives to the Supreme Court! You're screaming and shouting about an out of control judiciary which doesn't reflect conservative values which is entirely made up of conservatives, you fucking ignorant rubes.
Well, that's just the Supreme Court. What about all those Federal District Judges and Circuit Court Judges?
What do you think?
Federal judges are appointed for life. Twenty five out of the last thirty seven years, we've had all Federal judiciary appointments made by Republicans. Assuming every nominee of every President was consented to by the Senate, that would make our Federal judiciary made up of about 68 percent conservatives.
But that's only if you assume that the Senate is approving every nominee by every President. Frist, right now, is freaking out because Democrats have blocked ten of Bush's judicial nominees.
It's so horrible! My God, it's a Constitutional crisis! How can Republicans stand it??? When evil Democrats have used phony baloney procedural technicalities to stop ten qualified justices from being appointed by Bush!
And Bush is understandably upset, because Bush is a guy who firmly believes that if a President nominates a qualified judge to the federal court, that guy ought to go to the federal court! And when Bush says something, you can take it to the bank that he means it!
(AP) Preparing to make his first judicial nominations, President Bush has dumped the last of President Clinton's judicial nominees, including the first black appellate judge in the circuit with the most minorities in the nation...
Mr. Bush on Monday officially withdrew 62 executive and judicial nominations made by Clinton in his last days, including Gregory. The 4th U.S. Circuit — comprising Maryland, North Carolina, South Carolina, Virginia and West Virginia — includes more minorities than any other circuit in the nation.
D'oh! Fucking bullshitter.
People, your Supreme Court, your Circuit Courts, and your District Courts in the Federal Judiciary are filled with conservative judges. There are hardly any "liberal" judges in the federal judiciary. And, while I cringe at and disagree with a lot of rulings--particularly this Supreme Court's 4th Amendment cases--this overwhelmingly conservative federal judiciary has done as well as any other judiciary in the history of this country.
By and large, they've honored their profession and the Constitution, and regardless of political affiliations, have ruled on the letter and the spririt, and the intent of the law.
Bush v. Gore, excepted.
And these nuts, these fucking out of control, raving lunatics, who are running the country, and the ignorant, misinformed, historically oblivious fools who keep voting for these clowns, are crying like bitches and waging a war against a conservative judiciary.
People, it's not the judiciary they hate. It's the Constitution.
And, you know, America is nothing but the Constitution.
Hey, Ann Coulter, tell me again who hates America...
